Global Terms & Conditions
Updated: October 1st, 2026
These Terms & Conditions ("Terms") govern your use of sidephone.com and purchases through global.sidephone.com (the "Global Store"), operated by Side Technologies Inc., a Canadian corporation ("Sidephone," "we," "us," or "our").
By placing an order, you agree to these Terms and the applicable policies referenced below. Purchases through our U.S. Store are governed by separate terms issued by Side Technologies USA Inc.
1. Products & Orders
We aim to provide accurate product information, pricing, and availability.
When you place an order, we'll confirm it by email. Your order is accepted when we send this confirmation, and we may begin processing and shipping it immediately.
You may request cancellation through the link in your order email, where available, or by contacting Sidephone Support. We'll accommodate requests where fulfillment can still be stopped. Once fulfillment can no longer be stopped, our Returns & Refunds Policy applies, subject to your statutory rights.
We may verify order information and decline or cancel orders where permitted by law, including for suspected fraud, payment issues, product unavailability, obvious errors, or legal restrictions. If we cancel your order, we'll notify you and promptly refund any payment collected.
2. Pricing & Payment
Prices are displayed in the currency shown at checkout. Applicable taxes, shipping charges, and other fees collected by us will be disclosed before you complete your purchase.
Global orders are shipped Delivered Duty Paid (DDP). Sidephone is responsible for applicable import duties and customs charges associated with standard delivery. Any shipping charges collected from customers are disclosed before purchase.
By placing an order, you authorize us and our payment providers to charge your selected payment method. You agree to provide accurate payment and billing information. Your financial institution may apply additional charges.
3. Shipping & Delivery
Shipping destinations, processing times, delivery estimates, costs, customs responsibilities, and related conditions are described in our Shipping Policy.
Delivery timelines are estimates unless expressly guaranteed. Your rights concerning delays, lost shipments, and failed deliveries are governed by applicable law and our Shipping Policy.
4. Returns & Refunds
Returns, cancellations, exchanges, refunds, and any applicable return fees or shipping costs are governed by our Returns & Refunds Policy, together with any mandatory consumer rights applicable to your purchase.
5. Warranty & Consumer Rights
Sidephone products are covered by our Limited Warranty, where applicable.
Our warranty is provided in addition to your statutory consumer rights. Nothing in these Terms or our other policies limits rights or remedies that cannot legally be excluded or restricted.
6. Software & Connected Services
Sidephone devices may include proprietary software, open-source components, and third-party technology.
Use of proprietary Sidephone software is governed by our separate Software License Agreement. Certain applications, connectivity offerings, and connected services may have additional terms.
Third-party service availability may change or be interrupted. Sidephone may also modify or discontinue services where permitted by law, subject to applicable commitments and consumer rights.
7. Website Use & Intellectual Property
The Sidephone name, branding, website content, and proprietary technology are owned by or licensed to Side Technologies Inc. and protected by applicable intellectual property laws.
You may use our website and services for lawful purposes. You must not engage in fraud, interfere with our systems, compromise security, or misuse our services.
We may restrict access to Sidephone-controlled accounts or online services when reasonably necessary to address fraud, security threats, unlawful activity, or material misuse, subject to applicable law and customer rights.
8. Liability & Events Beyond Our Control
To the extent permitted by law, we are not responsible for indirect or unforeseeable losses or disruptions beyond our reasonable control.
Where legally permitted, our total liability arising from a particular product or paid service is limited to the amount you paid us for that product or service.
Nothing in this section limits the benefits expressly provided under our Returns & Refunds Policy or Limited Warranty, including transferable warranty coverage.
These limitations do not apply to fraud, intentional misconduct, death or personal injury caused by our negligence, or any liability or consumer remedy that cannot legally be limited.
If circumstances beyond our reasonable control delay our obligations, we'll take reasonable steps to minimize disruption and provide any notices or remedies required by law.
9. Privacy
Our Privacy Policy explains how personal information is collected, used, shared, and protected.
Our Global Store is hosted by Shopify, which collects and processes information when you visit or make purchases. Shopify may also use information from your interactions with our store, other merchants, and Shopify to provide enhanced services, including analytics, personalization, and advertising.
Information may be shared with Shopify and third-party service providers and processed in other countries. For more information, see our Privacy Policy, Shopify's Consumer Privacy Policy, and Shopify's privacy controls.
10. Governing Law & Disputes
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, except where mandatory laws of your jurisdiction provide otherwise.
Nothing in these Terms restricts your right to bring a claim before a court or authority where applicable law permits.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on our website with an updated date.
The version applicable when you placed your order will continue to govern that purchase, unless otherwise required by law or agreed with you.
12. General
Our specific policies and any applicable checkout or service terms govern their respective subjects where they differ from these general Terms. Mandatory legal rights always prevail.
If any provision is unenforceable, the remaining Terms will continue to apply. Our failure to enforce a provision does not waive our right to enforce it later.
We may transfer our rights and obligations under these Terms as part of a business sale or reorganization, subject to applicable law and without reducing your mandatory rights.
Our products and software may be subject to export and sanctions laws. You must not export, transfer, or use them in violation of applicable law.
