U.S. Privacy Policy

Updated: October 1st, 2026

Sidephone respects your privacy. This Privacy Policy explains how Side Technologies USA Inc. collects, uses, shares, and protects personal information when you visit our U.S. Store, purchase a Sidephone, use our U.S. cellular subscription services, contact us, or interact with related services.

We aim to collect information for clear purposes, provide meaningful privacy choices, and limit unnecessary data collection.

1. Who we are

Side Technologies USA Inc. is responsible for personal information processed through:

  • usa.sidephone.com, our U.S. Store.

  • U.S. cellular subscriptions offered through our partner Gigs.

  • Associated U.S. order fulfillment, customer support, returns, warranties, and related services.

Our Canadian affiliate, Side Technologies Inc., separately operates sidephone.com, configure.sidephone.com, global.sidephone.com, and the Community Creations directory.

Information from those experiences may be shared with Sidephone USA when you proceed with a U.S. purchase, request assistance, or interact with services involving both companies. Activities operated by our Canadian corporation are covered by the Global Privacy Policy.

Privacy inquiries: privacy@sidephone.com

Mailing address: Side Technologies USA Inc., 699 Upper Court Street, Binghamton, NY 13904, United States.

2. Information we collect

We collect different information depending on how you interact with Sidephone.

Customer and order information. When you purchase from our U.S. Store, we collect or receive your name, email address, telephone number, billing and delivery addresses, products ordered, configuration selections, transaction details, and order history.

Payment information. Shopify and supported payment providers process hardware payments. We receive relevant billing information, payment status, transaction references, and limited payment-method details, but do not directly receive or store complete payment card numbers or security codes.

Website and configurator information. We may process IP addresses, browser and device details, approximate location inferred from IP addresses, cookies, referral information, website interactions, and conversion events. Configuration selections and relevant activity from our Canadian affiliate's configurator may be shared with us to facilitate U.S. purchases.

We may use session recordings or heatmaps to improve website usability. We intend to mask or exclude sensitive inputs and exclude payment-entry screens and other sensitive areas.

Customer communications and support. When you contact us, request a return, or make a warranty claim, we may collect contact details, support messages, order information, device identifiers or serial numbers, issue descriptions, and photographs, videos, or diagnostics you voluntarily provide.

Marketing and promotions. We may collect newsletter preferences, product availability requests, waitlist registrations, early-access information, promotional engagement, contest entries, and related contact details.

Reviews and research. We may receive ratings, reviews, testimonials, creator contributions, voluntary survey responses, research feedback, and related submitted content. Public contributions submitted through Sidephone's shared website or Community Creations directory may be administered by our Canadian affiliate.

Compliance and fraud prevention. Where necessary, we may process transaction-risk information, address-verification details, and information required to satisfy applicable payment, tax, trade, fraud-prevention, or other legal obligations.

3. U.S. cellular subscriptions through Gigs

Sidephone USA offers cellular subscription services through Gigs and its authorized carrier and service partners.

When you activate or manage a Sidephone cellular subscription, we may receive or access limited information necessary to administer the service, including:

  • Subscriber identity and contact information.

  • Mobile plan selection, activation, and subscription status.

  • Telephone numbers and relevant SIM/eSIM or device identifiers.

  • Subscription billing records and payment status.

  • Limited connectivity and technical information necessary for service administration, troubleshooting, and customer support.

Sidephone USA does not ordinarily access detailed call or messaging records. Our access is generally limited to the administrative and support information necessary to provide and manage your subscription.

Gigs and its carrier partners may independently collect and process additional information required for identity verification, telephone number transfers, network operations, telecommunications compliance, emergency services, and other connectivity functions.

Cellular subscription payments and recurring charges are processed through Gigs and its authorized payment providers rather than through the standard Shopify hardware checkout. Sidephone USA does not directly collect complete payment card details for these subscription payments.

We use subscriber and connectivity information received through Gigs for activation, billing, customer support, fraud prevention, and service administration.

We do not use Gigs-derived subscriber or connectivity records to create advertising audiences.

Certain telecommunications information may be subject to additional confidentiality requirements, including rules concerning Customer Proprietary Network Information (CPNI). Such information is handled in accordance with applicable law and the responsibilities of the relevant service providers.

Gigs and its carrier partners may independently process information under their own privacy policies and service terms. For additional information, see the Gigs Privacy Policy.

4. How we use information

We use personal information to:

  • Process and fulfill hardware orders, payments, deliveries, returns, refunds, and warranty claims.

  • Activate, administer, and support U.S. cellular subscriptions.

  • Provide customer support, software updates, and troubleshooting.

  • Send order confirmations, shipping updates, requested notifications, and necessary service communications.

  • Send and personalize promotional communications where permitted.

  • Operate and improve our websites, configurator, products, and services.

  • Measure advertising effectiveness, understand customer journeys, and create permitted advertising audiences.

  • Operate product reviews, research activities, Community Creations, contests, and promotions.

  • Detect fraud, assess transaction risks, protect our systems, and prevent misuse.

  • Comply with applicable legal, tax, regulatory, and recordkeeping obligations.

  • Establish, exercise, or defend legal claims and protect our legitimate business interests.

We and our payment or ecommerce providers may use automated risk signals or scoring to identify potentially fraudulent transactions, account abuse, or suspicious activity.

Consequential decisions made by Sidephone concerning flagged orders receive human review rather than relying solely on automated scoring. Payment providers may independently decline transactions under their own risk-management processes.

5. Marketing, advertising, and communications

You may subscribe to promotional emails through newsletter forms, checkout, or other appropriately disclosed signup experiences.

We may personalize marketing using your communication preferences, eligible purchase information, checkout activity, and permitted website engagement. We may also measure email opens, clicks, and conversions.

We may send abandoned-checkout reminders where legally permitted. You can unsubscribe from promotional communications at any time using the link in those messages.

Essential order, transaction, security, cellular-service, and support communications do not depend on a marketing subscription.

We do not currently intend to send promotional SMS messages. Transactional text messages may be used for orders, delivery, activation, account security, or customer support as appropriate.

We use or intend to use advertising and measurement services from Meta, Google and YouTube, TikTok, Reddit, and X.

Subject to applicable privacy requirements and choices, these services may receive cookies, browser identifiers, website activity, conversion events, purchase information, and appropriately protected customer identifiers to support advertising measurement, personalization, retargeting, and eligible customer audiences.

These integrations may use browser-based technologies or server-side conversion tools.

We do not sell, rent, or license customer databases to independent data brokers for their own marketing.

However, certain disclosures to advertising or measurement partners may qualify as a "sale," "sharing," or targeted advertising under applicable U.S. state privacy laws, even where no monetary payment is involved.

Customers may exercise applicable advertising privacy choices as described in Section 10.

6. Shopify and Enhanced Services

Our U.S. Store is hosted by Shopify.

Shopify processes information when you browse our store, check out, or purchase a product, including information about your device, browsing activity, order, and transaction.

Shopify Network Intelligence is enabled on our U.S. Store.

Shopify Network Intelligence allows Shopify to use information about customer interactions with our store, other merchants, and Shopify to provide Enhanced Services.

These services may support security, store improvements, personalization, advertising relevance, and measurement. Shopify may process certain information for its own purposes under applicable terms and privacy rules.

Information may be processed by Shopify and authorized third parties located in countries outside the United States.

We do not use the separate Shopify Audiences product and have no current plans to enable it.

Applicable customer privacy choices, including opt-outs concerning certain advertising-related processing, are described in Section 10.

For more information, visit the Shopify Consumer Privacy Policy and Shopify Privacy Portal.

7. When we share information

We disclose relevant personal information when reasonably necessary for legitimate business activities, including to:

  • Shopify, payment processors, and ecommerce service providers.

  • Gigs, its authorized payment providers, and cellular carrier and service partners.

  • Warehouses, shipping carriers, customs brokers, and logistics providers.

  • Authorized repair and warranty-service providers.

  • Intercom and other customer-support providers.

  • Website analytics, session-recording, advertising, and email marketing providers.

  • Affiliate attribution, review-management, research, and promotional administration providers.

  • Side Technologies Inc., our Canadian affiliate, and authorized personnel supporting shared operations.

  • Authorized prospective investors, lenders, buyers, advisers, or successors when reasonably necessary for financing, investment, mergers, restructuring, acquisitions, or business sales, subject to appropriate confidentiality and privacy safeguards.

  • Government authorities, courts, regulators, or other recipients where permitted or required by law, including for security, fraud prevention, or legal compliance.

Our Canadian and U.S. companies maintain separate storefront order records. Authorized personnel may share relevant information for customer support, fulfillment, fraud prevention, warranty services, accounting, security, and other legitimate business operations.

We intend to use AI features within Intercom to assist human customer-support personnel. We also intend to restrict customer-support conversations and attachments from being used to train general-purpose or third-party AI models through appropriate contractual and technical controls.

Affiliate partners may receive referral, conversion, commission, and limited transaction-reference information, but not customer names, email addresses, telephone numbers, or shipping addresses.

8. Information about your Sidephone device

Sidephone does not require a proprietary Sidephone account to use the phone and does not operate personal cloud synchronization for your contacts, messages, photographs, or other personal content.

We do not collect routine behavioral or performance telemetry, automatically receive crash or network-state logs, or collect or track the precise GPS location of your phone.

Sidephone-operated software-update infrastructure may process limited technical information, including IP addresses, device models, software versions, and update requests, to deliver and secure updates.

Customers may voluntarily submit bug reports or technical diagnostics to assist with troubleshooting.

Before sending a device for repair, replacement, return, or warranty service, customers should back up their information, remove SIM/eSIM credentials and accounts where applicable, and factory-reset the device.

If a device cannot be reset, authorized service personnel or repair partners may access or erase personal information only when reasonably necessary for the requested service, using appropriate safeguards.

Independent applications, operating-system components, mobile carriers, and connected services may process information, including location information authorized by the user, under their own privacy practices.

9. Reviews, Community Creations, and promotions

We may collect product reviews, ratings, photographs, videos, testimonials, research feedback, and entries for giveaways, contests, or promotional activities.

If you submit content for publication, information such as your chosen display name, review, project attribution, images, videos, files, or links may become publicly accessible.

We intend to keep private information such as customer email addresses, shipping addresses, and order numbers unpublished as part of ordinary public contributions.

Content may be reviewed or moderated before publication. Applicable submission terms will explain publication rights and permitted promotional reuse.

You may request corrections, attribution changes, or removal of published contributions by contacting support@sidephone.com. Requests involving previously authorized promotional uses will be assessed under applicable permissions and law.

Giveaways and contests may require eligibility checks, winner verification, and prize fulfillment. Additional terms will be provided in the applicable promotion's official rules.

Sidephone's shared Community Creations directory is operated by Side Technologies Inc. under the Global Privacy Policy.

10. Your U.S. state privacy rights and choices

Depending on your state of residence and the privacy laws applicable to our business, you may have rights to:

  • Know or access the personal information collected about you.

  • Request correction of inaccurate personal information.

  • Request deletion of eligible personal information.

  • Obtain a portable copy of eligible information.

  • Opt out of certain sales or sharing of personal information and targeted advertising.

  • Limit certain uses or disclosures of sensitive personal information where applicable.

  • Opt out of certain qualifying profiling or automated decision-making activities where applicable.

  • Appeal certain privacy request decisions where required.

  • Exercise your privacy rights without unlawful discrimination or retaliation.

To exercise a privacy right, contact our Privacy Officer at privacy@sidephone.com.

We may verify your identity or request additional information where reasonably necessary to protect customer information and prevent unauthorized requests.

We will respond within applicable legal deadlines and explain any lawful reasons for refusing or limiting a request.

Where required, we provide a process to appeal decisions concerning privacy requests. Authorized agents may submit requests on behalf of consumers where permitted by law, subject to applicable authorization and verification requirements.

Advertising and data-sharing opt-out

You can manage applicable advertising-related privacy choices through our U.S. Store's Your Privacy Choices page.

Depending on applicable law, these choices may allow you to opt out of disclosures considered a sale or sharing of personal information or processing for targeted advertising.

You may also manage available website cookie preferences through Cookie Settings and submit additional privacy requests to privacy@sidephone.com.

We honor legally required browser opt-out preference signals, including Global Privacy Control, where applicable.

For Shopify's own privacy choices, visit https://privacy.shopify.com/.

Certain telecommunications information processed independently by Gigs or its carrier partners may be subject to separate privacy rights, legal protections, and request procedures.

11. Categories of information disclosed for advertising

Where permitted by applicable law and subject to required privacy choices, we may disclose the following categories of personal information for advertising, measurement, or activities legally defined as selling or sharing:

Online identifiers and website activity. Information such as cookie identifiers, IP addresses, website interactions, and conversion events may be disclosed to advertising, analytics, and measurement providers.

Eligible contact information. Customer identifiers, such as email addresses or telephone numbers, may be disclosed in appropriately protected forms to advertising providers for permitted customer audiences.

Purchase and conversion information. Eligible order details, transaction references, and conversion events may be processed by advertising partners or Shopify Enhanced Services.

Referral and affiliate information. Referral identifiers, attribution events, and limited transaction references may be disclosed to affiliate measurement partners.

These disclosures may support targeted advertising, retargeting, personalization, conversion measurement, and campaign performance analysis.

Gigs-derived telecommunications subscriber and connectivity records are excluded from Sidephone's advertising audiences.

Applicable opt-out rights and privacy choices are described in Section 10.

12. International processing

Sidephone USA operates in the United States and works with our Canadian affiliate and service providers in other countries.

Personal information may be stored, accessed, or processed in the United States, Canada, and other countries where authorized service providers operate.

These arrangements may support ecommerce, customer service, payment processing, software updates, telecommunications administration, analytics, logistics, and other legitimate business activities.

Where applicable law imposes restrictions on international processing or data transfers, we take steps to comply and use appropriate legal safeguards.

Information is not necessarily stored only in the country where a customer resides.

13. Retention and security

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including purchases, subscription administration, accounting, taxation, customer support, warranties, fraud prevention, dispute resolution, legal claims, and regulatory compliance.

When information is no longer reasonably necessary, we delete or anonymize it as appropriate, subject to applicable legal and operational requirements.

Certain records may be retained where necessary for legal obligations, investigations, disputes, or legal holds. Information in backups may remain temporarily until ordinary backup retention cycles expire.

We use technical and organizational safeguards designed to protect personal information, including restricted access, secure authentication, encryption where appropriate, service-provider protections, and security incident-response procedures.

No security system eliminates every risk. We investigate suspected incidents and provide notifications where required by applicable law.

14. Children

Our websites, online purchasing services, and cellular subscription enrollment are directed to adults and individuals legally permitted to enter the relevant contracts.

Sidephone is a general-purpose mobile phone, not a product specifically marketed or directed to children.

Parents or guardians may choose to provide the hardware to a minor, but ordinary use of the device does not require a proprietary Sidephone account or involve Sidephone-operated routine device tracking.

Cellular subscriptions are subject to the age and eligibility requirements in the applicable service terms.

We do not knowingly collect children's personal information in violation of applicable law. If we learn that such collection has occurred, we will take appropriate steps to address it.

15. Updates to this Policy

We may update this Privacy Policy as our products, services, processing practices, or legal obligations change.

We publish updated versions with a revised effective date, provide additional notice of material changes where appropriate or required, and obtain new consent when necessary for a new use.
